1. Second Chances Law

On August 8, 2025, the Ministry of Labor issued Resolution 3287 establishing the procedure for reporting beneficiary information under the Second Chances Law:

In accordance with Article 6 of Law 2208 of 2022, a progressive reduction in the payment of parafiscal contributions is established. This entails a gradual decrease in these payments for companies that hire individuals who have served a prison sentence or those currently serving a sentence with work release, parole, or provisional suspension of sentence with work authorization.

Application Process for Employers:

(i) Complete the form on the Ministry of Labor website.

(ii) The Ministry of Labor will request certification from the corresponding penitentiary authority.

(iii) Once a response is received from the penitentiary authority, the Subdirectorate of Family Benefit will forward the consolidated information to the Ministry of Social Protection.

(iv) Upon meeting the requirements, employers may access incentives related to Family Compensation Fund contributions for two (2) years from the employee’s start date.

2. Occupational Safety and Health Licenses

On May 15, 2025, the Ministry of Health and Social Protection issued Resolution 0908 of 2025, establishing the requirements and procedures for issuing, renewing, and modifying occupational safety and health (OSH) licenses for individuals and legal persons.

(i) Scope of Application: Applicable to natural and legal persons requesting OSH licenses and to the Departmental and District Health Secretariats responsible for their issuance and oversight.

(ii) Validity of Licenses: Licenses will be valid for 10 years and renewable for the same term.

(iii) Application Procedure: Requests will be submitted via a web application provided by the Ministry of Health and Social Protection.

(iv) Renewal Period: Renewal applications may be filed within 3 months before the license expires.

(v) Oversight: Health Secretariats will oversee compliance with the conditions established for providing OSH services.

(vi) Exemptions: The resolution does not apply to faculty members in academic programs.

(vii) Compliance Plan: In the event of noncompliance with requirements, a compliance plan will be agreed upon with verification within 30 business days.

This regulation aims to enhance sector oversight through more efficient, transparent procedures that are aligned with the needs of the country’s risk management system.

3. Internal Work Regulations

Under Labor Reform Law 2466 of 2025, employers have until June 24, 2026, to update their Internal Work Regulations. Below are some of the items to be modified and/or updated:

(i) Disciplinary Procedure.

(ii) Implementation of flexible working hours.

(iii) Hiring SENA apprentices.

(iv) Updates on the scope of Workplace Harassment (Mobbing).
