1. We invite you to keep in mind the following labor obligations for the end of 2024 and the beginning of 2025, which are detailed below:
i. Legal Bonus: Deadline for payment to the employee before December 20th.
ii. Severance Interest: Deadline for payment to the employee before January 31st, 2025.
iii. Severance Payment: Deadline for deposit to the funds before February 14th, 2025.
iv. Payment of Endowment: For employees who apply, the endowment must be delivered before December 20th, 2024.
2. The Ministry of Labor issued Resolution 2200 of 2024 on June 7th, 2024, which defines the processes and conditions to which the entities involved must be subject when granting the incentive (Jobs for Life Program).
Incentives:
i. For young people between 18 and 28, the beneficiary will receive 30% of one (1) current legal minimum wage – as its acronym in Spanish SMLMV.
ii. Women over 28 years old who earn up to 3 CLMW, the beneficiary will receive 20% of one (1) CLMW.
iii. Men over 28 years old who earn up to 3 CLMW, the beneficiary will receive 15% of one (1) CLMW.
iv. People with disabilities, the beneficiary will receive 35% of one (1) CLMW.
v. Employers who do not report contributions to PILA or who have been beneficiaries of the Protection Mechanism for the Unemployed in the 4 months or more before joining, the beneficiary will receive an additional 10% to the additional percentages mentioned.
Some Exclusions:
i. Politically exposed natural employers.
ii. Employers with PEP.
iii. Employers with Unpaid Leaves of more than 15 days within six (6) months
iv. Associated Work Cooperatives
3. The Constitutional Court determined, through Sentence T-266 of December 18th, 2024, that every employer has an obligation to analyze cases in conjunction with other categories of discrimination, such as being a woman head of household or a trans woman. This analysis focused on gender and other categories of discrimination must be especially reflected in the processes carried out under Law 1010 of 2006.
