On March 3, 2026, the Chamber of Deputies unanimously approved, with 447 votes in favor, a bill proposing amendments to the Federal Labor Law aimed at regulating the right to digital disconnection.

• Addition of Article 68 Bis. This provision establishes that employees have the right to disconnect from digital work communications once their working day has concluded, as well as during vacation periods or authorized leaves. Exercising this right must not result in any labor sanctions. Should employees perform additional work beyond their working hours, such time must be compensated as overtime in accordance with the provisions established by law.
• Amendment to Article 132, Section XXXIII. In the case of employees working under a teleworking arrangement, employers may not require them to address or resolve work-related matters outside the working hours established in their employment agreement.

According to the explanatory memorandum accompanying the bill, the purpose of this reform is to promote a better balance between professional and personal life, as well as to safeguard the health and well-being of employees by guaranteeing their right to disconnect from work-related communications outside their established working hours.

The initiative has now been submitted to the Senate for review. If approved, it will be promulgated by the Federal Executive and will enter into force on the day following its publication in the Official Gazette of the Federation (Diario Oficial de la Federación).
