Reduction of the Standard Workweek

On March 3, 2026, the Decree amending Article 123, Section A of the Mexican Constitution was published in the Official Gazette of the Federation (Diario Oficial de la Federación), establishing the progressive reduction of the standard workweek in Mexico. The reform entered into force on March 4, 2026.

This reform is part of broader changes to the Mexican labor framework aimed at improving the balance between work, rest, and the personal life of employees.

Under the reform, the standard workweek will be reduced to 40 hours, in accordance with the terms to be established by secondary legislation.

The reduction will be implemented gradually from January 1, 2027, through 2030, as follows:

Parallel Considerations:

  • For every six working days, employees must be granted at least one day of rest with full pay
  • New Rules for Overtime Limits
    • Overtime work may not exceed twelve hours per week, which may be distributed up to four hours per day, for a maximum of four days within that period, and must be compensated at 100% above the regular hourly wage.
    • Any overtime exceeding the above limits obligates the employer to pay 200% above the regular hourly wage, in accordance with applicable labor legislation.
    • Minors under 18 years of age are prohibited from performing overtime work.
  • Under no circumstances may the reduction of the standard workweek result in a reduction of employees’ salaries, wages, or benefits.

The Congress of the Union will enact the necessary amendments to secondary legislation within 90 days following the publication of the reform.
