Issued by the Ministry of Labor, repealing and rendering ineffective circulars issued by the Ministry of Labor and adopting measures to streamline administrative guidelines.
The purpose of the Resolution is to repeal and render ineffective 11 circulars to streamline administrative guidelines and ensure that the obligations and actions of the Ministry of Labor are based exclusively on the legal framework currently in force.
Consequently, the repealed circulars may not be used as an independent legal basis for requiring compliance with obligations or imposing sanctions, and the provisions outlined in the Constitution, laws, regulations, and applicable case law currently in force must be applied.
The repealed circulars are listed below:
Article 8. No revival. The repeal of the circulars referred to in Article 1 does not automatically revive previous circulars, instructions, or administrative criteria that had been replaced, amended, or rendered ineffective by them. Any applicable rule must derive from a valid and competent legal source currently in force.
Article 9. Publication and communication. This Resolution shall be published in the Official Gazette and on the Ministry of Labor’s website. It shall be communicated to the Vice Ministries, the General Secretariat, the Directorates, the Offices, the Territorial Directorates, the Special Offices, and the Labor Inspectorates for their information and application.
Article 10. Effective date. This Resolution shall take effect as of the date of its publication in the Official Gazette. It shall repeal or render ineffective, according to their substantive nature, the circulars expressly listed in Article 1.
